Kingfisher Golf Links sued over defective golf cart

Chul Woo Ha filed the complaint through attorney G. Anthony Long.

Kingfisher’s general manager Naotsu Zu Suzuki was not available for comment, according to manager Kosuke Sato yesterday.

In his complaint, Chul Woo Ha said he and his friends were playing golf at Kingfisher on Sept. 8, 2008 and was driving a golf cart provided by Kingfisher during their game.

While driving the golf cart on a downward slope of the golf course, he attempted to apply the brakes which failed.

“Because the brakes did not work, the golf cart began to increase in speed on the downward slope and Ha was heading for a big tree located on the golf course,” Long said in the complaint.

It added that Ha could not effectively control the golf cart due to the defective brakes.

“Ha, in an effort to avoid collision, turned the cart and jumped off the cart,” the complaint stated.

In the process, it added, Ha suffered a fractured shoulder bone.

Long said his client is asking for damages in excess of $75,000 after suffering “bodily injury, personal injury, pain and suffering and mental anguish” as a result of Kingfisher’s “negligence.”

Ha is also asking for compensatory damages in an amount to be proved in trial; actual damages to be proved at trial; liquidation damages; consequential and special damages in an amount to be proved at trial; cost of suit; and such other relief as the court deems just and proper.
