Jesse R. Babauta, 32, was also directed to surrender any firearm registered under his name, prior to his release.
Babauta appeared without counsel after the judge determined he was ineligible for a court-appointed counsel.
Assistant Attorney General George Hasselback argued that Babauta, when temporarily released, should not be allowed to come home, where his wife is also living.
Associate Judge Ramona V. Manglona ordered Babauta’s arrest for assault and battery and interfering with a domestic violence report.
According to the information filed in court by Hasselback, Babauta threatened to kill his wife, while slapping and punching her in the head in the presence of their children on Aug. 1.
Babauta also threatened his wife — whose knees and legs were already bleeding after she was pushed to the ground — that she would be locked up in a closet, deprived of food until she die if she would call the police, the information stated.
Babauta was described by Hasselback as a significant threat to the community.
He was advised by the court to look for possible third-party custodian, to stay away from their house, and not to have any direct or indirect contact with his wife.
The court set the preliminary hearing for Oct. 13, while the arraignment will be held on Oct. 19.
If he posts bail, Babauta mustsurrender his travel documents, should not leave the island, and must stay away from the seaport and airport.
