Wiseman orders deportation of guest worker in piracy case

“The court finds by clear and convincing evidence that the respondent…is a deportable alien,” part of Wiseman’s Oct. 7 order stated, noting that Min Jo of South Korea was convicted of one felony on May 8, 2009.

He pleaded guilty on Dec. 9, 2008.

He was issued non-resident worker’s permit on July 26, 2007 which expired on March 22, 2008, records showed.

 “I submit that Mr. Min Jo has failed to comply with the term and conditions of his entry and therefore, is a deportable alien,” said Assistant Attorney General Kathleen R. Busenkell.

Min Jo has not departed the island, she added.

Min Jo and his manager, Il Cho, were arrested after the Federal Bureau of Investigation raided Seoul Video Store in Chalan Kanoa on March 26, 2008.

The two were charged in federal court with one count of conspiracy, two counts of copyright infringement, and three counts of trafficking in counterfeit labels.

They pleaded guilty to one count of trafficking in counterfeit labels and the remaining charges were dismissed as part of the plea agreement.

The two were placed on three-year probation and Min Jo was referred to CNMI Immigration which determined that he is a deportable alien.
