The civil complaint, which seeks a jury trial, was filed on Tuesday by commission’s regional attorney Anna Y. Park, who is representing Brenda Ann Muna.
Several “Does” were also included in the complaint.
It stated that Pacific Airport Services has continuously employed 15 or more persons. The company provides cleaning services and airport counter operations.
The complaint stated that Muna filed a charge against the defendants with the EEOC more than 30 days prior to the filing of lawsuit.
“The commission found that the defendant subjected Brenda Ann Muna and other similarly situated employees to a hostile work environment on the basis of sex, female,” the EEOC stated.
The defendant failed to take effective remedial action regarding the hostile work environment, the complaint added.
Since Aug. 20, 2006, Muna suffered sexual harassment from her supervisor David Flores, the complaint said.
“Flores slapped Muna and other employees on their buttocks with his hand. Further, Flores asked Muna in a sexually suggestive matter…purposely placed his pelvic area near Brenda Ann Muna’s face and made other sexually suggestive comments and acts,” the complaint stated.
Flores also sexually harassed Jeding Matagolai by requesting in a sexually suggestive matter that “she sit in his lap and telling her she had a ‘nice ass,’ ” the complaint added.
Muna complained to management about the sexual harassment committed by her superior and other management officials.
But “despite Muna’s complaints, defendant took no action against Flores,” the complaint said.
In Aug. 2006, Muna wrote a letter to the company president and complained of the continuing sexual harassment.
After an investigation, “the result still required [Muna] to be supervised by Flores,” the complaint said.
Muna was compelled to resign on Jan. 24, 2007 due to management’s lack of action.
