Man denies assaulting girlfriend

KOROR (Palau Horizon) – The man who was charged for assaulting his girlfriend with a water pitcher has entered a not guilty plea to the assault and battery with a dangerous weapon, assault and battery, assault and malicious mischief charges.


Richard Kyota appeared for arraignment on November 13 with counsel Public Defender Jason B. Shaw and denied all his charges.

Assistant Attorney General Elizabeth Avore appeared on behalf of the government.

Kyota was released from custody after posting $250 cash and was ordered to stay away from the victim.

His status conference is set for December 8, 2009 at 8:30 a.m.

Kyota was charged for hitting his girlfriend with a water pitcher on September 6.

The police affidavit filed in court stated that Kyota “slapped the victim twice in the face and choked her around the neck.”

The document stated that the victim called police for assistance at 3:30 am on September 6 and reported that she was beaten up by her boyfriend at their residence in Ngesekes, Ngerbeched.

The document stated that when the police officer arrived at the victim’s place, he saw that there was a fire burning in front of the house and the defendant was already in a patrol car.

The document stated that the victim was crying because the defendant burned her personal belongings.

The document further stated that a police officer took a fire extinguisher and put out the blaze.

According to the affidavit, the victim and the defendant were sleeping when the victim’s cell phone rang. The victim turned her cell phone off which made the defendant angry and asked her who was calling her at that hour.

The defendant then took a water pitcher full of frozen water and threw it at the victim causing her bruise to her arm.

The defendant then slapped her twice in the face and choked her around the neck.

The victim managed to escape and ran outside the house and hid. She heard him called out for her name and was looking for her.

The victim then called police for assistance. Fifteen minutes later she saw that there was a fire in front of her house. When she went to see what was burning, she found out that it was her belongings.

The document stated that defendant poured out a gas fuel to the belongings and set it on fire.
