Pelisamen is the former administrator of the Rita Kaipat estate. Together with his then-attorney Joseph Arriola, Pelisamen was charged with wire fraud and money laundering involving $625,575 in estate money.
He was convicted last June.
Arriola, who was recently extradited from the Philippines, has pleaded not guilty.
Pelisamen’s attorney Douglas F. Cushnie informed the court that his client was on Guam for surgery and should return to that island for post-operative examinations.
“Due to circumstances involving the Commonwealth Health Center and its medical referral mechanism, which [I] cannot explain, Mr. Pelisamen was not sent to Guam until Nov. 25, 2009 for the required procedures,” Cushnie stated in his motion.
He said his client called him from Guam and informed him about his appointment tomorrow [Dec. 2] “to determine whether he is ready for and will have kidney surgery on Guam.”
Cushnie said Hawaii is also being considered “if Guam physicians are unable to do the required procedures.”
He asked the court to reschedule the sentencing for Dec. 4.
