Court dissolves Schorr TRO

Schorr has already sued his neighbor, Jose M. Bautista, and Reyad Tagle for damages.

Associate Judge Perry Inos dissolved on Dec. 28, 2009 the TRO issued 13 days earlier by Associate Judge Kenneth Govendo against Bautista, a Capital Hill resident.

In his statement to the court, Schorr said he discovered in the morning of Dec. 9, 2009 that all of the tires of his two cars were slashed.

“I had a gut feeling that it was Jose Bautista who [slashed the tires] because he did not welcome our recent move into the house next to his residence,” Schorr stated.

He said the landlord also had two tires of his truck slashed.

The incidents have been reported to police.

“I have been told of several other incidences with Mr. Bautista. I am not the first who called [the Department of Public Safety] for their assistance but there are other people who had done the same thing for his disturbing the peace activities,” Schorr said.

But the court found that it has no subject matter jurisdiction over the case because the relationship of the parties are not within the protected class covered under the Domestic and Family Act of 2000.
