Variety learned that Palacios was finally found at 3 p.m. yesterday.
He is scheduled to be arraigned today.
The Superior Court dismissed on Dec. 31, 2009 the vehicular homicide case against Palacios without prejudice after the AGO told the court it would not be able to go forward with the Jan. 12, 2010 jury trial due the unavailability of prosecutors.
A man was killed while four others were injured in the incident that happened on Dandan Road.
On April 8, 2009, the AGO charged Palacios with one count of vehicular homicide, one count of driving under the influence, three counts of reckless driving, and one count of driving on right side of highway.
Asked for comment, Rep. Joseph M. Palacios, R-Saipan, said his son Angel returned to Saipan yesterday morning.
He said his son was on Guam “looking for job to support his two-and-half year old baby girl.”
With the re-filing of the case against his son, the lawmaker said: “I just wish the [AGO] would have been more prepared.”
He had been attending all the court hearings for his son, and he said “[the court] was also frustrated” with these developments.
“The court finds that the recent handling of this case by the Office of the Attorney General is a travesty of justice,” Manglona stated in her Dec. 31, 2009 order dismissing without prejudice the case against Palacios, then 21.
Representative Palacios said “everybody was hurt and feeling bad” because of the accident, and his son had been telling him that “he should have been the one killed and not his friend since high school.”
On April 1, 2009, the complaint stated, Palacios was operating a south-bound pick-up truck but lost control of it, resulting in a collision with an SUV heading north on the same road.
One of Palacios’ four passengers died while the other three sustained serious injuries.
