Borja, 35, a Tinian resident, has signed a plea agreement, admitting the offense of assault and battery, and violating an order of protection.
The Attorney General’s Office then moved for the dismissal of all other counts filed against Borja,
For the offense of assault and battery, Superior Court Associate Judge David A. Wiseman sentenced Borja to one year imprisonment, all suspended except for 120 days.
For the offense of violation of an order of protection, Wiseman imposed six months incarceration, all suspended, except for 30 days.
Wiseman said both sentences will run concurrently as he credited the 23 days Borja already served at the Department of Corrections facility.
Wiseman took into consideration the urging of Borja’s family which “will suffer unique hardships without Borja’s monetary support as…jobs are scarce on Tinian.”
Wiseman said Borja “shall be incarcerated on Tinian at [the Department of Public Safety] and shall be permitted to leave the detention facility on Tinian on work release (for the purpose of maintaining his current employment) between the hours of 6 a.m. and 6 p.m.”
Each Friday evening, Borja will travel to Saipan at his own expense and report to the jail facility where he will remain until Sunday evening when he returns to Tinian.
After his release from prison, Borja will be placed on three years probation under the direction and supervision of the Adult Probation Office.
The court said Borja will not possess any illegal firearms, will perform 100 hours of community work service, pay a $100 fine, a $25 assessment fee, and a probation fee to be determined by the Adult Probation Office.
