Judge hears arguments on Villagomez bail motion

Bennett,  who heard arguments from both parties on Wednesday, ruled that a written decision would be forthcoming.

Assistant U.S. Attorney Eric O’Malley represented the federal government. For the defense the attorneys were Vincent Torres, Joey San Nicolas, and Ramon Quichocho. Attorneys Donald Horgan, Leilani Lujan, and David Lujan appeared telephonically also on behalf of the defense.

On Tuesday, Bennett dismissed the U.S. government’s motion to strike the defense’s reply.

“The government is correct that the [defense’s] reply is untimely. The court is mindful that the rules governing procedure are critical to the fair administration of justice because they provide a fair playing field for all parties.

However…the court has already fully and analyzed the defendants’ reply. As such, striking the reply would make little sense,” Bennett said in his written ruling.
