Romel Sambilay, together with his wife Ginalynn Sambilay, filed a complaint against Dial Rent to Own and Jesse Markub Babauta.
Through their lawyer Victorino DLG. Torres, the Sambilay couple is asking the court to render judgment against the defendants for compensatory damages, economic and non-economic damages, loss of consortium, for medical care and expenses, bodily injury and special damages.
The Sambilays are also asking for future damages, economic and non-economic damages, such as pain and suffering and necessary and reasonable medical expenses.
On Sept. 10, 2009 Mr. Sambilay was a passenger on the back of the pick-up truck while he was working for CUC when a Dial Rent to Own car, driven by Babauta, caused a sideswipe collision which injured Mr. Sambilay, according to Torres.
The collision, Torres said, caused Mr. Sambilay to be thrown out of the back of the pick-up truck causing him to land on the ground with great force.
As a result, he suffered a broken bone, abrasion to the arm, and contusion to his left knee, the complaint said.
