Marine surveying firm sues companies

Through its counsel Steven P. Pixley, Allied Marine Surveyors Limited named as defendants International Bridge Corp. and Inter Bay Circle Inc.

The lawsuit was filed in federal court.

Allied Marine is engaged in marine surveying, marine risk assessment, underwater inspections, repairs, salvage operations, and related business activities.

Pixley said Allied Marine has provided marine related services to the defendants for approximately 20 years.

“The parties have developed a course of dealing which is fairly to be regarded as establishing a common basis of understanding for interpreting their expressions and other conduct,” Pixley said.

Inter Bay was the operator of the motor tug boat “Marianas Voyager, formerly known as “June,” and the barges “Martha E” which was later renamed “Tamara V,” barge “BC4602,” and “Nusantara Abadi 2.”

International Bridge is a general construction company based on Guam.

At all times relevant to this complaint, Pixley said International Bridge acted in concert with Inter Bay regarding its business dealings with his client Allied Marine.

Beginning Jan. 2, 2004 and ending on July 11, 2008, the complaint said, Allied Marine provided various marine related services to the named vessels in the CNMI, Guam, and various foreign ports.

Pixley said the defendants owed his client the amount of $307,020.26 which included principal and interest.

Pixley is asking the federal court to cite the defendants to appear and answer all of the matters alleged; to enter a decree in favor of his client against the defendants, jointly and severally, awarding Allied Marine  damages, with interest and costs; award Allied Marine reasonable attorney fees and costs; and other relief deemed proper by the court.
