Steven Aguon’s jury trial for immigration document fraud case rescheduled

Aguon has denied the charge of immigration document fraud.

The court originally scheduled his jury trial for Dec. 12, 2011.

Aguon has been serving time in jail for a separate sex abuse case.

Approximately 450 pages of discovery documents have been forwarded to the defense.

“The review process is complicated by the fact that [Aguon] is currently incarcerated in the local Department of Corrections on an unrelated matter,” according to both parties’ stipulation requesting continuance.

Court-appointed defense attorney Michael Evangelista represents Aguon while Assistant U.S. Attorney Beverly McCallum is prosecuting the case.

In his submitted Form G-325A and U.S. Citizenship and Immigration Services Form I-130, which is a petition for alien relative, Aguon stated the he was married to Linlin Song, but they were divorced on Feb. 23, 2009.

Aguon’s statement was material to the determination by USCIS of Linlin Song’s application for lawful permanent resident status.

Linlin Song was indicted after she filled out USCIS Form I-485 to apply for an adjustment of status, or register permanent residence. Her Form G-325A indicated that she was married and her current husband is Steven Romie Aguon.

But Linlin Song was living with a different man, the indictment stated.

Linlin Song has entered an Alford plea of child neglect in a separate case in CNMI Superior Court.
