In the last status hearing, Diaz told the court that he was still trying to get in touch with his DNA expert and determine when he would prepare to testify at trial.
Guam District Chief Judge Frances Tydingco-Gatewood granted Diaz’s request additional time to contact his expert.
Assistant U.S. Attorney Clyde Lemons Jr. filed a notice of entry of appearance as new prosecutor for the case, replacing Assistant U.S. Attorney James J. Benedetto who is “relocating.”
Diaz is represented by attorney David Banes.
Earlier, Chief Judge Ramona V. Manglona granted Diaz’s request for a court-appointed investigator.
The court approved the $800 fee for the investigator.
According to the indictment, between on or about Aug. 1, 2010 and Sept. 30, 2010, Diaz planed in from Guam to entice the victim “to engage in sexual activity” which is sexual abuse of a minor in the third degree under CNMI law.
Diaz is currently detained at the CNMI Department of Corrections.
