The U.S. Court of Appeals for the Ninth Circuit earlier affirmed then-Chief Judge Alex R. Munson’s order, awarding costs to Kan Pacific for expenses incurred to translate relevant documents in this case.
The appellate court also affirmed the district court’s decision, granting summary judgment in favor of Kan Pacific.
Taniguchi, a professional baseball player in Japan, fell through a wooden deck while at Mariana Resort.
In 2008, Taniguchi sued the hotel for negligence.
Munson awarded Kan Pacific costs in the amount of $7,732.30 while Taniguchi got nothing.
The Ninth Circuit said “Taniguchi did not provide sufficient evidence to raise a material issue of fact in view of the declaration of Kan Pacific’s agent regarding Kan Pacific’s lack of negligence.”
