Judge David A. Wiseman imposed a five-year sentence on Borja, all suspended except for one year, and credited eight days the defendant already served at the Department of Corrections facility.
Upon release from prison, Borja will be placed on three years’ probation.
Wiseman ordered Borja to pay a $100 fine, court costs, probation fee, and $144 in restitution to J.C. Café Poker, representing the amount not recovered by police.
Borja will not have any contact with that establishment, including its parking lot, for the duration of his probation, the court ordered.
He will complete 50 hours of community work service and obey other conditions in the plea agreement.
Other charges of theft and resisting arrest were dismissed with prejudice by the court as moved by the prosecution.
On May 29, 2011, the plea agreement stated, Borja unlawfully entered J.C. Café Poker and took money from the cashier’s booth.
Police recovered $500 cash from Borja.
Borja’s unattended pick-up truck was later located near Lung Feng Market and items stolen from the Department of Commerce were also found by the police.
