Frankie S. Pangelinan, who is represented by court-appointed attorney Robert T. Torres, was charged with using excessive force on two individuals while he was still with the Department of Public Safety.
He wants to reschedule his jury trial to Aug. 22 from May 23, 2011.
Pangelinan, who has denied the charges, said he made the request to allow his counsel to prepare for his defense which includes investigation, preparation of expert and witness testimony, and review of grand jury transcripts which they recently receive from the prosecution.
According to the indictment, on July 6, 2010, Pangelinan, then a police officer, pepper sprayed into the eyes of Felipe “Phil” Kalen and Alafanso Anso Kintin, resulting in bodily injury.
Assistant U.S. Attorney James J. Benedetto is prosecuting the case.
