A MAN convicted of theft has been arrested again, this time for “ice” possession, police said.
Benjamin Lee Rios, 40, was brought before Superior Court Judge Perry B. Inos for his initial appearance and bail hearing yesterday afternoon.
Inos retained the $5,000 bail order he earlier imposed on the arrest order of Rios for illegal possession of a controlled substance.
In his affidavit of probable cause, Detective Sean White said police were on routine patrol in Koblerville near KL Market, when they saw a vehicle in the parking lot.
Police officers Jesus Cepeda and Rhonda John approached the vehicle, “having personal knowledge that a wanted person by the name of Benjamin Lee Rios was operating that vehicle,” White told the court.
Before authorities could reach Rios, the vehicle exited the parking lot and stopped at the defendant’s residence, also in Koblerville, White said.
There, the authorities talked to Rios who consented to a search of his vehicle.
Found inside the car was a pouch that contained a dark glass container with a white napkin containing “a clear plastic pipe typically used for smoking ‘ice’ and a cut off white straw with a crystalline substance on the passenger side of the vehicle,” White said.
A field test showed that the straw and pipe tested presumptive positive for the presence of “ice,” White said.
Early this year, Judge Inos ordered Rios to report to the Department of Corrections to serve his 14-day jail term for theft.
Inos originally sentenced Rios to one year imprisonment, all suspended except for 14 days, with credit for two days time served.
Inos accepted the plea agreement between the prosecution and Rios who admitted the offense of theft.
It was not immediately known whether Rios had already served his sentence.
