Two days for assault and battery

Govendo imposed on Daniel, 24, a one-year jail term, all suspended, except for two days he already served at the Department of Corrections facility.

Daniel  signed a plea agreement and admitted assault and battery.

The remaining charge of assault with a dangerous weapon was dismissed with prejudice by the court as moved by the Attorney General’s Office.

Daniel is placed on two years supervised probation.

He must attend and complete anger management and counseling, alcohol and drug counseling/treatment, a parenting class, and any other counseling recommended by the treatment provider, or the Adult Probation Office.

Daniel will find and maintain full-time employment.

He will perform 100 hours of community service, or may substitute proof of 10 verifiable job applications for 10 hours of community work service until he finds full-time employment.

Assistant Attorney General Eileen Wisor represented the government, while Assistant Public Defender Douglas Hartig served as counsel for Daniel.

On or about Dec. 18, 2008, Daniel spat on the face of a female household member, the prosecution said. He also threatened the victim with a knife.
