The bank, through attorney Thomas E. Clifford, also named Byung Gil Choi in the complaint.
When contacted by the Variety, a Scuba and Resort staffer said Byung Gil Choi, their former general manager, resigned a year ago.
The staffer said they will inform the management about the lawsuit.
The complaint said FHB had to collect $39,463.60 in payments as a result of breaches of terms and conditions of the merchant agreement by Scuba and Resort.
Transactions were disputed by the cardholders who claimed they were fraudulent, and sales slips were not signed by the cardholders, the complaint said.
The bank recovered $8,925.15 on Dec. 22, and $2,113.82 on Dec. 23, 2010 by debiting Scuba and Resort’s FHB checking account.
A balance of $27,410.46 remains outstanding, in addition to the $313.51 merchant fee due and owing, the complaint said.
