
SUPERIOR Court Judge Kenneth L. Govendo sentenced Ray Anthony Fitial, 41, to 10 years’ imprisonment, but all suspended except six years and six months for aggravated assault and battery.
Fitial will serve his sentence without the possibility of parole, early release, work release or any other type of release program, according to a four-page judgment of conviction and commitment order issued on March 13, 2025.
“Defendant shall be released from the custody of [the Department of Corrections] on March 2, 2031, at 8 a.m.,” Judge Govendo stated in his order.
At his sentencing hearing, Fitial was in the custody of Corrections and was represented by Assistant Public Defender Karie Comstock, while Assistant Attorney General Frances Demapan appeared for the government.
Judge Govendo said Fitial will be placed under the supervised probation of the Office of Adult Probation for a period of five years, beginning on March 2, 2031.
Moreover, he will pay a $200 fine and court fees; a probation fee of $600; $3,046.21 in restitution to the victim to cover her medical expenses at the Commonwealth Healthcare Corporation; and $594.50 to cover the victim’s emergency medical transport expenses provided by the Department of Fire and Emergency Medical Services.
In addition, Fitial will perform 250 hours of community service and shall not have direct or indirect contact with the victim or her residence.
Judge Govendo said “defendant’s failure to comply with any of the enumerated conditions above, except for conviction for minor traffic infractions, shall be grounds for revocation of probation and contempt of court charges.”
