Omar Nawaz is escorted by a Corrections officer at the courthouse on Monday morning.

OMAR Nawaz, who is believed to be homeless, was arrested by the police for pulling his pants down and showing his privates to a 6-year-old girl at a restaurant in Garapan on Friday.

Nawaz, 34, was charged with indecent exposure and disturbing the peace.

He appeared in the custody of the Department of Corrections before Superior Court Associate Judge Joseph N. Camacho for a bail hearing Monday morning.

Assistant Public Defender Karie Comstock was appointed to represent Nawaz at the hearing, while Assistant Attorney General Frances Demapan appeared for the government.

After hearing from the parties, Judge Camacho imposed a $5,000 cash bail on Nawaz and remanded him to the custody of Corrections.  Nawaz was ordered to return to court for a preliminary hearing on Nov. 27 at 10 a.m., and for an arraignment on Dec. 2 at 9 am.

According to the complaint against Nawaz, the girl’s mother told police that she was to have dinner with her 6-year-old girl and 8-year-old son at a restaurant, which has glass windows.

She said they chose to sit beside a glass window with her children facing north, while she sat facing south.

The mother said she observed a man, later identified by police as Nawaz, walking back and forth in front of the glass window where they sat.

She said her daughter then asked if she could sit somewhere else. The mother said her daughter had a sad look on her face after gazing out the glass window.

When the mother turned to the direction where her daughter was staring, she saw Nawaz with his pants down, showing his privates and smiling.

The mother yelled at Nawaz and asked the restaurant staff to call the police. Nawaz then ran south. Police later found Nawaz at Paseo De Marianas Road and arrested him.

Nawaz declined to provide a statement to the police.
