TWELVE non-resident workers have filed a lawsuit in federal court against a construction firm for alleged non-payment of their wages and overtime compensation.
The workers sued TM Corp. and owner Jae Guk Yoon for alleged violation of the Fair Labor Standards Act, the Minimum Wage and Hour Act, the Non-Resident Workers Act, and breach of contract.
The plaintiffs demanded payment of their unpaid wages, overtime pay and liquidated damages.
David Banes, counsel for TM Corp., was not available for comment yesterday, according to his staff.
In the complaint filed in the U.S. District Court, attorney Jay H. Sorensen said the defendants failed to pay the plaintiffs the required minimum wage and had paid the workers overtime at a rate less than what was required by law.
Sorensen further alleged that “from the time of plaintiffs’ first employment and within the past six years, defendants failed to pay plaintiffs’ compensation for employment in excess of 40 hours per week at the rate of one and one-half times each plaintiffs’ regular rate of pay.”
Sorensen alleged that TM Corp. failed to pay his clients who worked on several projects for the CNMI government according to the wage rates set by law.
