2 convicted, 1 acquitted in ‘ice’ case

A FEDERAL jury yesterday convicted two men, but acquitted the third defendant in an “ice”-related case.

The 12 jurors came up with a verdict after deliberating for four days in the nine-day trial of Tsai Jung Yao, Tsai Chung Mao and Lawrence M. Fleming.

The jurors found Tsai Jung Yao guilty of conspiracy to possess methamphetamine with intent to distribute and distribute methamphetamine, 10 counts of aiding and abetting the distribution of methamphetamine, and one count of distribution of methamphetamine.

But Tsai Jung Yao was found not guilty of two counts of aiding and abetting the distribution of methamphetamine, and one count of possession of methamphetamine with intent to distribute and distribution of methamphetamine within 1,000 feet of a school.

Tsai Chung Mao was convicted of conspiracy to possess methamphetamine with intent to distribute, and two counts of distribution of methamphetamine.

The jury acquitted Fleming on one count of possession of methamphetamine with intent to distribute and distribution of methamphetamine, and one count of possession of methamphetamine.

The jury, however, failed to decide on the conspiracy count against Fleming, prompting the court to declare a mistrial as to that count.

U.S. District Court Judge Alex R. Munson set a new trial for the conspiracy count against Fleming on Sept. 16.
