$30,000 cash bail set in Tinian ice case

Anthony Borja Cruz was arrested early last month and appeared in court on Monday for a bail hearing.

Cruz is represented by the Public Defender’s Office and  is unable to post bail. A preliminary hearing is set for June 18 at 1:30 p.m. and he is also ordered to appear in court for an arraignment at 9 a.m. on June 23.

Based on the declaration of probable cause in support of the issuance of an arrest warrant, Detective Melvin I. Monkeya of the Criminal Investigation Bureau of the Department of Public Safety stated that on April 5, 2008, a source informed them that Cruz was selling ice.

At about 8:39 a.m. on the same day, members of the Tinian detective unit conducted a controlled buy-walk operation.

The source called Cruz on the telephone and ordered $50 worth of ice.

Cruz told him to be at the front entrance of the Tinian Dynasty Hotel and Casino in about an hour.

Operatives of the Tinian detective unit posted themselves at the pre-arranged location.

According to the affidavit, Cruz gave the source a crushed glass-like substance inside a clear, cut-off straw which later tested presumptive positive for the presence of methampethamine.

The operatives  asked Cruz to go with them to the police station for questioning and he agreed.

Cruz’s wallet yielded three cut-off straws containing substances which also tested presumptive positive for the presence of methamphetamine, the affidavit stated.
