HAGÅTÑA (The Guam Daily Post) — A man suspected of violating a court order allegedly assaulted two officers with the Guam Police Department who had to use a stun gun and a baton to restrain him, while also preventing the man’s mother and a dog from intervening in the apprehension.
On Friday morning, police responded to a report of Bayo Bye Likity, 34, allegedly violating a court order at an apartment in Dededo, according to a magistrate’s complaint filed in the Superior Court of Guam.
Upon the officers’ arrival, they saw Bayo Likity, who also had an active warrant for his arrest, eating outside the apartment.
According to the complaint, Bayo Likity, when confronted by police, continued eating, saying he did nothing wrong because he was outside the apartment. However, when told he would be taken to Dededo Precinct for questioning, Bayo Likity refused, ignored the officers and continued to eat.
Then, when asked to stand up and place his hands behind his back, Bayo Likity stated, “Can I wash my hands first? I’m eating.”
At the time, police noticed Bayo Likity was fidgeting and kept looking to his left as if he was preparing to flee before he suddenly got up from his chair, shoved an officer and tried to run into another apartment.
The complaint said an officer managed to grab Bayo Likity’s hands while another grabbed his legs, but Bayo Likity, during the struggle, elbowed and kicked the officers in an attempt to escape.
“Due to Bayo’s size advantage over the officers, he was able to prevent them from taking him down,” according to the complaint, which added the struggle continued and was happening up against a sedan parked near the stairwell of the apartments.
Then, while police were still trying to restrain Bayo Likity, one officer used his stun gun to “drive stun” Bayo Likity, but it had no effect. The officer was unable to confirm if it made contact with Bayo Likity, but police heard Bayo Likity scream “as if he felt the stun.”
According to the complaint, officers continued in the struggle before calling for additional units, however, at this time, Bayo Likity kicked one of the officers in the belly, making it difficult for him to speak.
While police were still trying to bring Bayo Likity to the ground, he allegedly kicked his legs out and “used his hands to reach behind” an officer’s head, which caused the officer’s forehead to slam into the pavement.
The other officer then was able to use his stun gun to attempt to stun Bayo Likity, “but the officer felt the effects of the taser and released the taser from his right hand.”
The officer who had been slammed to the pavement saw this, picked up the other officer’s stun gun and used it again to drive stun Bayo Likity “approximately three times, which had no effect,” according to the complaint.
Since the stun gun had no effect, the officer used his baton, but Bayo Likity’s mother, Tesmy Likity, intervened by allegedly punching the officer’s leg.
In response, the officer yelled at Tesmy Likity to move away from the area as she yelled, “I told you to arrest, not to slap,” according to the complaint.
As Bayo Likity was being hit with the baton, he continued to resist despite instructions. Tesmy Likity also continued to try to get between the officer and her son.
As the officer used his baton to hold down Bayo Likity’s legs, he “felt something sharp tugging on his left leg and discovered that a dog was biting his leg.”
The officer kicked his leg out and the dog released its bite. As the officer focused on restraining Bayo Likity, the dog bit the officer again, but the officer ignored it.
The two officers continued to struggle to secure Bayo Likity, but were later assisted by Bayo Likity’s father who threw his body on his son to hold him down. At this point, the officers were able to secure Bayo Likity in hand restraints, according to the complaint.
Afterward, more officers arrived and both Bayo Likity and Tesmy Likity, 62, were taken to the Dededo precinct. As a result of the struggle, both officers sustained abrasions to different parts of their body that included the forehead, knees, fingers, wrists and calves, along with cuts and pain in other areas.
Charges
On Monday, Bayo Likity was charged with two counts of assault against a peace officer as third-degree felonies, resisting arrest and violation of a court order as a misdemeanor and disorderly conduct as a petty misdemeanor.
According to the complaint, Bayo Likity in a 2022 misdemeanor case was ordered by the court to stay away from his mother and her residence. Tesmy Likity reported to probation officers on Sept. 8 that Bayo Likity had continued visiting her residence.
Tesmy Likity also was charged with assault against a peace officer as a third-degree felony, hindering apprehension and obstructing governmental functions as misdemeanors and disorderly conduct as a petty misdemeanor.
