Ex-DLNR technician sued for unreturned equipment

DLNR, in its complaint, is asking the Superior Court to order Deleon Guerrero to pay  general, consequential and compensatory damages, punitive damages and provide other relief as the court may deem appropriate.

The complaint stated that DLNR supplied Deleon Guerrero with equipment he could use to carry out his duties.

Deleon Guerrero was issued a laptop computer, accessories for the laptop including a mouse, flash drive and external drive, a Canon digital camera, a compact flash drive for the camera, accessories including a charger for a Motorola cellphone as well as office and car keys.  

On Aug. 31, 2006, DLNR Secretary Ignacio T. Dela Cruz notified Deleon Guerrero that he had been absent without leave for a total of 272 work hours.

 DLNR said Deleon Guerrero has “abandoned his work.”

It made several unsuccessful attempts to serve Deleon Guerrero who also made no attempts to contact DLNR concerning the issued equipment which were purchased with public funds and were just loaned to him.

DLNR terminated his employment on Jan. 2, 2007, but he refused to sign the termination letter.

DLNR sent a registered letter on Nov. 20, 2007 asking Deleon Guerrero to return the issued equipment.

Another letter was hand-delivered to him on Nov. 25 but he refused to accept it, DLNR stated.

 The issue was brought to the Attorney General’s Office on Dec. 18.

In a letter sent on Feb. 15, 2008, the AGO gave Deleon Guerrero 15 days to return the loaned items. The letter was unclaimed and returned to the sender.
