Court squashes bench warrant vs man who failed to show up for hearing

Associate Judge Kenneth L. Govendo yesterday said the matter “is already deemed closed” and the defendant,   Donny Swei, a Palauan citizen residing in Chalan Kanoa, “has been released” from the charges indicated in the bench warrant.

Then-Associate Judge Virginia Sablan-Onerheim issued the bench warrant against Swei on Sept. 25, 2002 and set a cash bail of $100.

Swei was charged with assault and battery and disturbing the peace in March 2001 for beating and wounding Lyn Swei.

The warrant service report was served to Donny Swei when he showed up in Superior Court yesterday for separate charges of assaulting his wife and another woman on Sept. 12 and March 17, 2007.

He pleaded guilty to one count of disturbing the peace and one count of assault and battery during a change of plea hearing on May 8, 2008.

Govendo accepted his plea and sentenced him to six months of imprisonment, all suspended except for three days with credit of three days for time already served for disturbing the peace, and one year of imprisonment, all suspended, except for three days with credit for time already served for assault and battery charge.

Govendo ordered both sentences to run concurrently.

Donny Swei was placed on supervised probation for one year and six months, to be served consecutively.

He was also ordered to pay a fine of $200, an assessment fee of $25 and a probation fee whose amount will be determined later.

In addition, he will perform 100 hours of community work service. The court also ordered him to submit an apology letter to the two victims and stay away from them.
