Four get prison terms for copper wire theft

 

Associate Judge David A. Wiseman sentenced Roland Kaipat and Vicente Kaipat after they entered a guilty plea to burglary and theft.

They were sentenced to five years in jail, all suspended except two years with credit for one day already served on Nov. 22-23, 2007.

The two defendants were ordered to report to the Department of Corrections on July 28 to commence serving their sentence. They will be released on July 6, 2010.

The court said the sentences of both defendants “shall run concurrently.”

The two will be placed on supervised probation for five years after their release. They will each pay $2,000  in restitution to the CNMI government, a fine of $500  and $100 in assessment fee. They will also serve 300 hours of community service and comply with the other conditions set by the court.  

Another defendant, John Santos, Jr., 19, entered a guilty plea to criminal mischief.

The court sentenced him to three years imprisonment, all suspended, except with credit for one day already served from Nov. 20-21, 2007.

He will be placed on supervised probation for three years.

In addition, Santos will pay $2,000 in restitution to the CNMI government, a $500 fine and an assessment fee of $25.

He was also ordered to stay away from recycling facilities and pawnshops within the CNMI, and perform 300 hours of community service.

Wiseman set the review hearing for Nov. 19, 2008.

The fourth defendant, Jeffrey C. Magofna, 27, entered a guilty plea to burglary, theft, and illegal possession of controlled substance.

Wiseman said copper wire theft has been rampant on island and its impact is widespread.

For burglary, the court sentenced Magofna to five years imprisonment, all suspended except  two years, and another two years imprisonment for possession of controlled substance.

Magofna received credit for time served on Nov. 22-30, 2007 and from Feb. 20 to July 6, 2008, or a total of 136 days.

Both sentences will run concurrently and are to be served without parole.

 Moreover, he was placed on supervised probation for five years after his release from custody. He will pay $2,000 in restitution to the CNMI government as well as a $500  fine and a $100 assessment fee.

Magofna will perform 800 hours of community service and comply with several other conditions set by the court.

He was remanded to the Department of Corrections and will be released on Feb. 22, 2010.
