Judge Ramona V. Manglona ordered the change of schedule for Miura’s filing deadline after finding good cause in the request filed by the defendant through his lawyers Bruce Berline, Mark B. Hanson and William M. Fitzgerald.
Manglona also set Sept. 2, 2008 as the deadline for any opposition from the government, and Sept. 5 as the deadline for Miura’s reply.
Manglona earlier set Aug. 8 as the deadline for the commonwealth and or the agent of the state of California to file an opposition brief. She also ordered Miura to file a reply brief no later than Aug. 22.
The hearing date remains the same, on Sept. 12 at 10 a.m.
On June 19, Miura appeared in court with his lawyers Berline, Hanson and Fitzgerald to apply for release on bail.
The government was represented by Assistant Attorneys General Jeffery L. Warfield Sr., Mike Nisperos and Kevin Lynch to oppose the application.
The court released its ruling and denied Miura’s application for release on bail pending the court’s determination of his proposed petition for a writ of habeas corpus.
The court said Miura is in the custody of the CNMI Department of Corrections on a governor’s arrest warrant awaiting extradition to the state of California.
The warrant was issued by Gov. Benigno R. Fitial on March 12, 2008 in response to a formal rendition by the governor of California. It was served to Miura at the Corrections facility on the same day.
Miura reaffirmed his intention to challenge the extradition by way of a habeas corpus petition to the court on May 28, indicating that he would apply for release on bail.
Miura is sought by California on charges of murder and conspiracy to commit murder for the 1981 death of his wife in Los Angeles. He was acquitted of the crime in Japan.
