The complaint was filed by Rufino Edward F. Tudela against Jamar Nuruzzaman, Geraldine Salas and Md. Salim Bhuiyan.
The plaintiff, through attorney Joe Hill, is asking the court to render judgment against the defendants and award him general, compensatory, special and punitive damages.
He is also asking for $3,800 out-of-pocket damages paid for the repair of his vehicle plus additional amounts to be proven at trial, for equitable award of attorney’s fees and costs, and other relief as the court may deem proper.
In his complaint, Tudela said, he was driving his 2004 Toyota Echo vehicle heading north toward Ates Drive at the intersection of Belimbines Street in Kagman 2 on May 1, 2007 and had the right of way when Nuruzzaman failed to yield the fight of way, hitting the car of the plaintiff.
Bhuiyan owned the vehicle operated by Nuruzzaman, and Salas was with Nuruzzaman when the accident occurred.
The plaintiff filed two causes of action, stating that Nuruzzaman was driving his vehicle at an excessive rate of speed.
He also said that Nuruzzaman failed to obey a traffic sign, did not keep a proper lookout, failed to avoid a collision with his car and did not yield the right of way.
As a result, the plaintiff said he suffered damages including the loss of use of his vehicle.
The plaintiff said Bhuiyan was negligent in trusting his vehicle to Nuruzzaman and Salas when he was aware that the two were negligent in operating his vehicle.
