Man who stole air-con condenser units gets one-year jail term

Associate Judge David A. Wiseman sentenced  Ivan Dela Cruz of Tanapag to one-year jail term, with credit for the six days he already served; and to two-and-a-half years in jail, all suspended, except for the one year with credit for time served.

The sentences will run concurrently with each other.

Wiseman also placed Dela Cruz on probation for four years.

He will pay a $100 fine, a $100 court assessment fee and $4,000 in restitution to the American Textile Factory.

He was ordered to stay away from the factory, recycling centers and pawnshops within the CNMI while on probation.

He will  seek and maintain full time employment, follow directions and instructions of the probation officer and will not leave the CNMI without court permission.

He will, moreover, render 300 hours of community work service, and report to the Department of Corrections on Oct. 24 at 10 a.m.

Wiseman set the review hearing for Feb. 25, 2009 at 9 a.m.

According to the affidavit filed by Detective Jesse James Stole, at about 3:15 p.m. on Oct. 5, 2007, they received a report about several large air-conditioning condensing units stolen from the compound of the American Textile Garment Factory in Tanapag.

A damaged fence at the rear portion of the compound indicated a possible point of entry.

The investigation also revealed drag marks in the wet and muddy ground.

Detective Simon Manacop, who responded to the scene, said the company maintenance personnel told him he found several large air-conditioning unit condensers sold to the Triple Star Recycling Center in As Perdido earlier.

Manacop said the units were muddy and dirty.

On Oct. 16, 2007, the maintenance personnel told police officers that he was making a routine check at the compound on Oct. 8, 2007 when he found the defendant sitting next to one of the air-conditioning condenser units at the back of the compound.

When confronted, the defendant told the maintenance personnel that he needed money to send to his wife in the states.

It will cost American Textile $50,000 to replace the stolen air-conditioning condensers.

The six large condensers cost about $7,500 each, while the two smaller condensers cost about $4,000 each.
