THREE men were arrested for stealing a four-wheeler ATV (2005 Suzuki LTZ 250) from a residence in As Gonno early on Aug. 25.
William Indalecio Jr., Nolan Magofna, and Ethan Don Sanchez were each charged with theft, which carries a maximum sentence of five years in prison and a $5,000 fine.
The defendants appeared in custody of the Department of Corrections before Superior Court Judge Lillian A. Tenorio for a bail hearing Tuesday morning.
Indalecio, 36, was represented by Assistant Public Defender Karie Comstock, while Magofna, 32, and Sanchez, 33, will each be appointed an attorney. Assistant Attorney General David Krach appeared for the government.
According to Judge Tenorio, the defendants may be released upon posting 10% of a $20,000 cash bail. She remanded the defendants to the custody of Corrections and ordered them to return for a preliminary hearing on Sept. 10 at 9 a.m. and an arraignment on Sept. 15 at 9 a.m.
The complaint states that the stolen ATV was valued at $7,525.07.
Police investigators reviewed security footage from a residence in As Gonno showing Magofna driving a green Toyota Camry, towing the 4-wheeler with Sanchez riding in it early that morning. Later the same day, police spotted Magofna in Chalan Kanoa and pulled him over.
In an interview, Magofna told investigators that Indalecio and Sanchez instructed him to drive to As Gonno while it was still dark. He said Indalecio directed him where to park, and then Indalecio and Sanchez tied the white ATV to the back of his car. Indalecio got back into the car while Sanchez rode the ATV as Magofna drove it to Coral Ocean Point, where they planned to hide it in the jungle.
Later, police conducting a routine check spotted the stolen ATV being driven recklessly by Sanchez in Kagman and pulled it over.
