Judge dismisses rape case vs businessman

Judge Ramona V. Manglona granted the government’s written motion to dismiss the case without prejudice. This means that the case can still be re-filed.

The court also “exonerated all bail conditions…including travel documents and the cash bail of $6,000.”

The jury trial set for Nov. 17 was vacated.

The case involved Jun Kitaoka, vice president of Paupau Tours Saipan.

He was arrested earlier this year in connection with the reported rape of a tourist in her hotel room.

An affidavit submitted to the court stated that the sexual assault that happened at the Fiesta Resort & Spa was reported to the Department of Public Safety on Feb. 28.

An affidavit stated that after going out for sightseeing, the defendant followed the victim to her hotel room.

The victim, who was already tipsy from beer and wine, woke up partly naked and covered with blanket, the affidavit stated.

The defendant, represented by attorney Vincent Torres, expressed great relief upon learning that the court has dismissed the case.

In an interview, Kitaoka, 42, who served five days in jail last March, said he now feels “very free.”

He said he had to resign as vice president of Paupau Tour when the case was filed against him.

Now that he has been cleared by the court, he said he will be appointed again to the same position.

“But I cannot forgive the person who did this to me,” he said.   

 Etsuko Muna, Paupau Tours’ president, said everybody still trusts Kitaoka.

She said they believe he did not do anything bad because they know he does not have “that kind of personality.”
