Associate Judge David A. Wiseman ordered the release of Hilario Angui who promised to appear for all scheduled hearings and obey all commonwealth laws.
The defendant, who was charged with stealing two laptops from the Commonwealth Health Center in November last year, is on two-year probation.
He was sentenced to two years imprisonment, all suspended except for 120 days with credit for time served. The defendant was asked to pay court costs and a fine of $200, write a letter of apology to the Commonwealth Health Center and stay away from it, unless as a visitor or a patient, and pay full restitution of $2,800.
He was also ordered to render 100 hours of community work service.
On Feb. 27, 2008, the defendant entered into a plea agreement with the government represented by his counsel, Assistant Public Defender Douglas W. Hartig. He pleaded guilty to one count of theft. In return, the government did not prosecute him for the other charges.
Detective Kevin R. Maratita filed an affidavit in court stating that the Department of Public Safety received a call reporting a theft incident on Sept. 21, 2007 at CHC.
Preliminary investigation showed that the complainant reported losing two laptops from two of the hospital’s offices valued at about $4,000.
The footage from the security cameras on Sept. 17-19 showed a man pushing and shaking the doors of the CHC offices.
The footage also showed the man carrying a white box under his arm when leaving the premises through the morgue area.
The same man wearing the same attire was seen in the area on the next day.
The footage showed the man —Angui — hiding a bulky object inside his shirt while walking toward the main entrance behind a woman.
On Sept. 24, 2007, the complainant dropped a copy of the surveillance footage to the office of the Criminal Investigation Bureau which led to the identification of the defendant.
Detective Simon Manacop said Angui had a criminal history of arrests and convictions as well as numerous involvements in burglary and theft incidents.
On Oct. 8, 2007, a representative of the complainant met the defendant at his residence in Koblerville. The defendant returned one laptop and said that the other laptop was in the possession of his friend.
