Four overstaying foreigners ordered to post bail

Associate Judge Perry B. Inos yesterday imposed a $1,000 cash bail each on Gu Liquiang, 30, a citizen of the People’s Republic of China, and Carlito I. Parahan, a citizen of the Philippines.

Chief Prosecutor Kevin Lynch appeared on behalf of the government.

If they will post bail, Gu and Parahan must appear for all scheduled hearings, obey all commonwealth laws, not leave Saipan without court permission, and keep all appointments with their lawyers.

The defendants are also ordered to report to the Immigration office three times a week and provide a sketch of their residence as well as contact numbers.

Gu, whose foreign student entry permit expired on April 5, 2005, was arrested by immigration officers at about 11 a.m. on Tuesday while he was unloading containers for Ming Li Corp. at the Sea Port Customs.

He failed to provide any valid labor and immigration documentation and identification.

Gu and three other persons were allowed to remain in the CNMI due to a criminal case. He was later informed that he had to leave the CNMI on April 7, 2008.

Parahan’s non-resident worker’s entry permit expired on June 10, 2000. He has already overstayed in the CNMI for seven years and five months.

Both defendants do not have any pending labor case, no temporary work authorization or pending employment application, no administrative action and they did not register with the Department of Labor for further employment opportunities.

On Tuesday, Inos imposed a $1,000 cash bail for the temporary release of Shan Guofu while another defendant Zhao Yang was ordered to post $100 cash and a $900 unsecured bond. Both are from China.     

Immigration investigator Nicolas T. Reyes filed a deportation case against Shan in Jan. 2002. He was arrested in Garapan at 10:48 p.m. on Tuesday.

Zhao Yang was arrested on Monday afternoon after he failed to provide any valid Labor or Immigration document.

All four defendants are to report to the court on Jan. 22, 2009 for an order to show cause hearing.
