Eria Elliot, a citizen of Palau, did not show up for his arraignment before Associate Judge David A. Wiseman yesterday.
Wiseman issued another bench warrant and recommended a $1,000 bail against the defendant.
Elliot, who frequents the streets begging for food and money from passersby, has been in and out of jail for various criminal charges.
Court documents showed that the defendant was arrested in July 2007 after Associate Judge Ramona A. Manglona issued a bench warrant for his failure to show up for court hearing for four criminal cases.
Manglona issued another bench warrant against the defendant last month for not showing up again for the same cases.
On Feb. 5, 2009, Wiseman issued another bench warrant against Elliot for failing to show up in court.
He was arrested the following day and brought to Associate Judge Kenneth Govendo’s courtroom.
Govendo released him after ordering him to come back to court for arraignment yesterday. He did not show up.
Govendo suspended all proceedings of the defendant’s cases on June 23, 2006, after he directed psychiatrist Dr. Willie Gutowski of the Commonwealth Health Center to examine the defendant.
Gutowski’s medical report showed that Elliot is a regular patient at CHC who is suffering from schizophrenia and auditory hallucinations.
He has been repeatedly admitted to CHC for acute psychosis related to alcohol and marijuana abuse, but Gutowski said Elliot was “competent to stand trial.”
Elliot’s cases involves assault and battery, shattering the window of a car, disturbing the peace for harassing customers at the Garapan Market while intoxicated, and hitting a woman with a serving tray.
