Associate Judge Perry B. Inos imposed a $6,000 bail on 35-year-old Antonio Mendiola Camacho in yesterday’s bail hearing, 10 percent or $600 of which will be in cash and the remaining amount in unsecured bond.
If he posts bail, Camacho will return to court whenever required to do so, obey all commonwealth laws, surrender all travel documents and not leave CNMI without court permission.
He will stay away from airports and seaports and not consume any alcoholic beverages in public places.
He will also keep all appointments with his attorney and have no direct or indirect contact with the victim.
Assistant Attorney General Edward Buckingham who represented the government told the court that the defendant had previously been sentenced to five-year jail term and another six-month jail term after he pleaded guilty to assault and battery, and for disturbing the peace.
Buckingham said the defendant had also been convicted for two counts of assault and battery and two counts of sexual assault.
Assistant Public Defender Michael Brown represented the defendant.
Camacho was arrested by police on Tuesday pursuant to an arrest warrant issued by Associate Judge David A. Wiseman on March 23.
Detective Simon T. Manacop filed an affidavit stating that a disturbance call was reported at a residence in As Matuis at 11:03 p.m. on March 21, 2009.
Manacop said the responding police officer met the victim who told him that she was beaten by her common-law husband.
The victim said she was sitting in the garage of their residence when the defendant arrived home drunk.
She asked the defendant why he came in late when she wanted to take their daughter who had fever to the hospital.
She said the defendant instead offered her a drink, which she accepted and threw away.
The defendant got mad and grabbed an unopened can of beer and threw it at her, but he missed.
The victim said the defendant then grabbed a wooden chair and stuck her on the left side of her head.
She got dizzy and fell to the ground. She said she heard the defendant laughing as he got into the car and left.
The responding officer saw a swelling on the left side of the victim’s head but she refused medical treatment.
She also asked the police not to confiscate the wooden chair the defendant used to hit her.
Camacho was arrested for assault with a dangerous weapon and disturbing the peace.
