Bernardita C. Aldan and husband Miguel Adlan, both residing in Idaho, through their counsel David G. Banes filed the complaint against the Saipan World Resort.
The plaintiffs are asking the federal court for a jury trial and for relief in general damages in an amount to be proven at trial, special damages, costs, attorney’s fees and any allowable pre-judgment interests, and other relief that the court may deem appropriate.
According to Mrs. Aldan, she was a guest at the World Resort restaurant at 7:20 a.m. on Dec. 29, 2007.
While having breakfast, she said she stood up to get her drink but before reaching the beverage counter, she slipped and fell down.
She said there was water on the floor by the beverage counter which she did not see.
She said there were no warning signs regarding the dangerous condition.
Mrs. Aldan said she placed her hand behind her back to break her fall. Her right leg was extended outward but her left leg was bent when she fell. She sustained a cut on her left knee which bled profusely.
She said the supervisor came over to assist her and admitted to her that there was a drainage under the beverage counter and that the water came out of the drainage.
She said the supervisor told her he had been requesting the hotel’s maintenance department to fix the problem.
Mrs. Aldan said World Resort was well aware that there was water on the floor, therefore it knew or should have known that the restaurant floor was wet and slippery.
However, she said, the defendant, “with reckless indifference to the rights of its guests took no precautions to either warn the guests or to make the restaurant less slippery or otherwise less dangerous.”
Banes said the fall caused his client to suffer severe injuries including pain in her left leg, left knee, right leg, shoulder and lower back, numbness in her right left, right and left toes, and locked knees.
She also suffered and continues to suffer tremendous mental pain and anguish, her lawyer said.
Banes said Mrs. Aldan’s injuries required physical therapy and medical attention for several months, and she is still recovering from her injuries.
She is suing the hotel for negligence and loss of consortium.
Banes said the defendant’s actions were outrageous and showed a reckless indifference to the rights of its guests and as a result, Mrs. Aldan will now be prevented from participating and enjoying the normal pleasures of life to which she was accustomed.
Also, the lawyer added, as a result of her fall, Mr. Aldan has been deprived of the care, companionship, aid, society and services of his wife.
