Senate takes action on proposed property damage bill

House Bill 8-12-1 was transmitted to the Senate after the House of Delegates passed the bill on final and third reading.

The bill seeks to amend the present stature because it was   uncertain as to whether negligent damage and destruction are covered under the lawThe proposed changes in the bill stated that destruction of a government property constitutes to a maliscious mischief and upon conviction is punishable by an imprisonment of not more than six months, or fined not more than $10,000.00, or both.  “Upon conviction for malicious mischief involving damage or destruction of government property, the person shall pay the entire cost of restoration or replacement of such property, or any part thereof, as determined by the court.  In cases involving government property in which more than one person is convicted, the court shall determine the allocation of cost for restoring such property, “the bill proposed.
