Simon Aldan Sebuu, represented by Assistant Public Defender Matthew J. Holley entered into a plea agreement with the government and pleaded guilty to one count of theft. Chief prosecutor Kevin A. Lynch appeared on behalf of the government.
Superior Court presiding judge Robert C. Naraja stated in his order that the defendant will serve the 45-day sentence consecutive to his on-going sentence in another criminal case which ends on Dec. 9, 2009.
Naraja also placed the defendant on four years of supervised probation under the Adult Probation Office. He must pay $100 court assessment fee, payable within 30 days after his release, $400 probation fee payable within three years after his release, and restitution in the amount of $1,325.
He must obey all CNMI, State and Federal laws as well as the rules of the Office of Adult Probation. Failure to comply with any of the conditions shall constitute a violation to the terms of the suspended sentence and shall subject the defendant to revocation proceedings.
Naraja has ordered the defendant to appear for a review hearing set for Feb. 8, 2010 at 1:30 p.m.
The Attorney General’s Office filed information against the defendant on June 19, 2007 stating that between April 21 and 27, 2007, the defendant took assorted tools belonging to Romeo Guevarra from the victim’s apartment’s balcony.
