Torres, R-Saipan, wants to see documents regarding NMC’s employment settlement agreements.
“Fernandez will respond to my request to make or create such records for inspection whether she likes it nor not,” Torres said in a statement.
Fernandez said the information Torres is requesting will violate the confidentiality of agreements.
“The documents you have requested, which include employment records, would also be exempt from public disclosure under the law, Fernandez has said.
But Torres, who opposes the application of the Open Government Act to the Legislature, said “no public entity or agency receiving public money is above the law.”
He said NMC and Fernandez are not immune to the law mandating disclosure of public records.
Fernandez said the Open Government Act requires public agencies to make public records available for inspection “but does not require agencies to create such documents.”
Torres has warned Fernandez of legal action if the NMC president will not comply with his request.
But Fernandez said any litigation based on Torres’s request would be unwarranted.
