THE Attorney General’s office has dismissed the charge against former Rota Department of Public Safety Resident Director Eusebio Manglona, leaving Rota Mayor Efraim Atalig as the only defendant in the case.

Chief Prosecutor John Bradley in an email told Variety that they filed the motion to dismiss  on Tuesday.

“He agreed to pay restitution,” Bradley said, referring to Manglona. “That leaves [Mayor] Atalig as the only defendant in the CNMI case.”

As for another co-defendant, Dean Manglona, Bradley said: “His case was already resolved by acceptance of responsibility, referral for adult diversion and payment of restitution.”

The judge recently signed an order suspending the case for that reason, Bradley said.

Mayor Atalig and seven of his former and current resident directors were charged by the AG’s office with misconduct in public office.

Vanessa Charfauros, Magdalena Mesngon, Dexter Apatang, Josepha Manglona, and Dennis Mendiola have already disposed the cases against them through a plea agreement with the AG’s office, which recently filed a motion to dismiss the case against Dennis Mendiola.

The CNMI government accused the Rota officials of taking government funded per diem and salary compensation to attend a Republican campaign rally on Guam on June 23, 2018.

Misconduct in public office is punishable by a prison sentence of not more than one year or a fine of not more than $1,000.

In federal court, Mayor Atalig, and co-defendant Evelyn Atalig, are accused of arranging CNMI government funded trips to California, Palau, Guam, and Saipan from Feb. 2018 to Aug. 2018.

A superseding indictment charged the Ataligs with conspiracy, wire fraud, theft from program receiving federal funds, and two counts of false statements.

Their jury trial will start on Aug. 4 at 10 a.m.
