Public Law 13-60 is very clear on the six months provisions of rehiring especially in this economic situation.
Thousands of employees have been threatened to be furloughed, and the Retirement Fund is near collapse and to come across an issue such as the rehire of employees who have recently resigned from your office is in itself a complete VIOLATION of CNMI laws.
An employee hired after 12/5/03, who subsequently resigns/fired, and refunds his contribution from the Retirement Fund is restricted from re-employment in the CNMI government for six months.
P.L. 15-13, the six-month restriction on reemployment per P.L. 13-60, was not repealed by the DCP law.
But even if the six-month restriction does not apply, other laws must be adhered to — namely, the JVA must be advertised, the applicants screened, interviewed, and a justification for hire must be made, etc. The typical process should take at a minimum 30-45 days.
