3 men, 1 woman sentenced for assault and battery

SUPERIOR Court Associate Judge Kenneth L. Govendo has sentenced three men and a woman in separate assault and battery cases.

Sheldon U. Remoket, Ryan Norita Rivera, Augustino Mustafa and Rowina Ogo pled guilty to assault and battery.

Judge Govendo sentenced Remoket to one-year imprisonment, all suspended except for 108 days. The defendant was also given credit for the 108 days he had already served. 

In addition, he was immediately placed on three-year probation, and was ordered to pay $40 court costs, and a $420 probation fee.

Remoket was also ordered not to have direct or indirect contact with Cheryl Palacios Ayuyu.

“When directed by the Office of the Adult Probation to do so, the Defendant shall submit to an evaluation at the Community Guidance Center and enroll in and successfully complete any recommended treatment or counseling; shall not possess or consume alcohol, marijuana or other illegal substances,” Judge Govendo said in his order.

Rivera was sentenced to one-year imprisonment, but all suspended. 

He will pay a fine of $250 and  court cost of $25 before the expiration of his probation period.  His one-year supervised probation period began on March 23. He will also pay a probation fee of $120.

 Rivera was ordered to have no direct or indirect contact with Richard Healer.

Mustafa was sentenced to one year imprisonment, all suspended except 60 days to be served day-for-day, without parole, work release, home detention or other form of early release.  But he was also given credit for time already served since Feb. 6, 2023.

Mustafa was remanded to the custody of the Department of Corrections and will be released on April 7 at 8 a.m.

He was ordered to pay a fine of $150 and a court cost of $25 before the expiration of the probation period

He will be placed on supervised probation for one year beginning on April 7. 

He will likewise pay a probation fee in the amount of $120, and  perform 50 hours of community work service.

“The defendant shall have no direct or indirect contact with Maria Cruz; and he shall write a sincere apology letter to Maria Cruz within 30 days from the sentencing hearing and submit it to [the Office of Adult Probation],” the judge said.

Ogo was sentenced to one-year imprisonment, but all suspended.

She was ordered to pay a $500 fine and a court cost of $25 before the expiration of her one-year probation period that starts on March 30. She will pay a probation fee in the amount of $120.

Judge Govendo also ordered Ogo to pay restitution to Maryann Borja in the amount of $262.55 for medical expenses incurred.

“The defendant shall perform 250 hours of community work service at a rate of no less than 20 hours per month,” the judge said. “The defendant shall not be allowed to convert the hours to an additional fine; the defendant shall have no direct or indirect contact with Maryann Borja; the defendant shall write a sincere apology letter to Maryann Borja within seven days from the sentencing hearing and submit it to OAP,” Judge Govendo said.

Moreover, Ogo “shall participate in and complete any other counseling or course of treatment (i.e., anger management) as deemed necessary by OAP or the Community Guidance Center.”

The three male defendants were represented by the Public Defender’s Office while Ogo was represented by attorney Janet King.

Assistant Attorneys General Steven Kessel, Carmen Borja and Frances Demapan appeared for the government.
