Nickasio Kintaro was also given credit for time served.
Chief Justice Arthur Ngiraklsong ordered that Kintaro shall received a mental, drug and alcohol evaluation and shall complete any recommended treatment while serving his jail term.Kintaro appeared for a plea hearing on November 21 where he pleaded guilty to the charges of burglary and grand larceny for criminal case 08-060 and escape to criminal case 08-086.The government dismissed the remaining charges in criminal 08-060 and in criminal case 08-086 in exchange of defendant’s guilty plea.Chief Justice Ngiraklsong sentenced Kintaro to three years of imprisonment to be served immediately.Kintaro was charged with one count of burglary, three counts of grand larceny, malicious mischief and larceny from a dwelling house for entering an art shop in Iyebukel on December 22, 2007 and stole various items from the shop.He was charged again with escape and obstruction of justice when he escaped from custody on January 30 during a court hearing for his criminal case 08-060.The police affidavit submitted in court states that Kintaro was escorted to the holding cell on January 30 at the Koror courthouse.The affidavit states that Kintaro was handcuffed to a metal bar in the cell and the court Marshall went up to the courtroom 104.The court Marshall then returned to the cell at 2:30 p.m. and heard from another Marshall that Kintaro had escaped.The affidavit stated that Marshall Flavin Rubasch saw Kintaro running away from the courthouse.
