CHIEF Judge Ramona V. Manglona of the District Court for the NMI has denied the request of Imperial Pacific International LLC to vacate the entry of default in favor of Winzy Corp. in its lawsuit alleging breach of contract.
Judge Manglona on Friday’s hearing also scheduled a default hearing for May 18 at 1:30 p.m.
The judge said IPI is permitted to participate and present evidence.
IPI was represented by attorney Juan T. Lizama while Winzy Corp. was represented by attorney Mark Scoggins.
According to the lawsuit, Winzy, in the early part of 2020, entered into an agreement with IPI to provide supervision and consulting services for the casino project.
“Winzy performed under the terms of the agreement in good faith, and in a good and workmanlike manner,” Scoggins said.
IPI, however, has failed to pay amounts owed under the agreement totaling $162,925, Scoggins added.
He said IPI has breached the agreement with Winzy to Winzy’s damage and in the alternative IPI is unjustly enriched by the services that Winzy provided to IPI.
