Defendant takes deferred plea in rape case

HAGÅTÑA (The Guam Daily Post) — A man entered into a deferred plea agreement for charges stemming from sexually assaulting a woman known to him multiple times over the course of two years.

Tony Vincent Taimanglo appeared in the Superior Court of Guam to change his plea to guilty in a 2021 case involving charges of criminal sexual conduct.

Court documents state Taimanglo was charged in November 2021 when a woman told officers with the Guam Police Department that Taimanglo sexually assaulted her in April and May 2019.

Before Taimanglo pleaded guilty, Judge Vernon Perez sought to confirm whether the terms of the plea, which consisted of the case being dismissed after Taimanglo spent time on probation, had been discussed with the victim.

Prosecutor Grant Olan said the victim in the case was “reluctant to testify” in a trial, was trying to move on with her life and did not feel like Taimanglo should go to prison. Olan said the woman felt Taimanglo needed treatment, and she was not afraid of Taimanglo but requested of Perez that he order Taimanglo not to harass, threaten or assault her.

Perez decided to accept the plea. Taimanglo pleaded guilty to third-degree criminal sexual conduct as a third-degree felony and was sentenced to three years of probation. Perez required Taimanglo to participate in counseling. Taimanglo was ordered not to threaten, harass or assault the victim.

Allegations

The victim in the case reported to police that Taimanglo allegedly sexually assaulted her when she was sleeping in April 2019, according to court documents.

In the second alleged incident, in May 2019, the woman said she awoke to find him again raping her.

She told officers that in April 2021, she was at a relative’s home when she woke up to Taimanglo inappropriately touching her genital area.

The woman said she reported the latest incident after she learned that Taimanglo had a cellphone recording of him molesting her while she was unconscious.

The video was recorded July 1, 2021, documents state.

Taimanglo allegedly admitted he recorded himself inappropriately touching the woman. GPD confiscated his phone, but it appeared to be cracked and officers were unable to view the evidence, documents state.
