THE federal court has rejected the “acknowledgment of satisfaction of judgment” filed by Fritz Pacific Project Development Services, its principal, Alfredo Cabael, and Imperial Pacific International LLC which was sued by Cabael for breach of manpower staffing subcontract.
At a status conference hearing on Wednesday, Cabael, who represented himself, informed the court that the parties have agreed to a payment schedule.
Cabael also told the court that IPI owed him $80,000.
But Chief Judge Ramona V. Manglona of the District Court for the NMI denied the acknowledgment of satisfaction of judgment and said she will enter an order rejecting the acknowledgment.
On Aug. 2, 2021, the federal court entered a judgment in favor of the plaintiff in the amount of $525,466.70.
Since that time, according to Cabael and IPI, IPI had made partial payments to the plaintiff.
In addition, Cabael and IPI have agreed to fully and finally resolve the remaining amount due under the judgment for a total sum of $330,000.
Of this amount, $250,000 was tendered by IPI to Cabael on Oct. 6, 2022.
To satisfy the remainder of the settlement, IPI and Cabael agreed to execute a promissory note in the amount of $80,000 which must be paid by IPI to Cabael in full no more than six months from the date of the agreement.
IPI and Cabael are now asking the court to enter a satisfaction of judgment and close the case.
Cabael and IPI, through Dongting Zheng, signed the satisfaction of judgment acknowledgement.
Initially, the plaintiff sought an order for an award for IPI’s nonpayment of manpower staffing services, interest, fees and costs in the amount of $745,303.90.
The complaint stated that around June or August 2018, IPI hired Fritz Pacific to provide manpower staffing services for the hotel-casino construction project in Garapan.
IPI, however, made partial payments only on the billings and invoices, the complaint stated.
