ENFORCEMENT officers of the Department of Lands and Natural Resources-Division of Parks and Recreation on Monday evicted Michael Kileleman who had been “camping out” near the shoreline on Beach Road in Garapan for almost seven months.
The enforcement officers led by Parks and Recreation acting Director Ray C. Sablan had to call the Department of Public Safety for assistance because Kileleman resisted when the enforcement officers arrived in the area at around 9 a.m. to implement the eviction notice.
Responding police officers placed Kileleman in handcuffs “because he kept resisting.” He was held in police custody but was released on Tuesday.
On May 19, DLNR Secretary Anthony Benavente sent Kileleman a notice to vacate the beach park public land, informing him that it was an unauthorized use of public land.
Benavente said Kileleman was utilizing a portion of the Garapan shoreline beach park public land for his “residential dwelling purposes.”
Benavente told Kileleman that DLNR “has no records authorizing you to use any portion of public land for these purposes.”
“This activity is in violation of the Division of Parks and Recreation’s regulations prohibiting unauthorized camping of unlimited duration,” the DLNR secretary said.
“Therefore, you must immediately vacate the beach park public land within 30 days from the date of the receipt of this letter. You must completely remove all improvements, personal property and belongings off the public land property,” he added.
Benavente also told Kileleman, “If you do not vacate the public land within 30 days after receiving this notice, we will have no alternative but to initiate legal action against you. If legal action is commenced, we will seek all remedies allowed by law, including the cost of removal of improvements, personal property, attorney fees, cost and interest.”
Kileleman signed the notice to vacate.
Kileleman and his friend, Norris Omengkar, were first seen “camping out” in the area in early February.
